Early Cape Cod Legal Document Providing Care for an Aging Parent, 1724

1p, measuring 7.5" x 12.25", Yarmouth, Barnstable County, Massachusetts, dated June 4, 1724. A legal document acknowledging the care of an elderly parent. Elisha Hall Jr. agrees to make a payment of £200 to his father, dated March 8, 1723/4. With an addendum below, in which Hall Jr. agrees to the following:

"…during ye natural life of his father ye above named Elisha Hall find and provide for him good and sufficient maintenance as to house room fires meat drink clothing washing lodging and tendance and what so ever may be needful and comfortable for an aged person of his ye said Elisha Halls quality and to his reasonable satisfaction in sickness and in health as above sd - and do also maintain one horse for his sd father winter and summer yearly…"

Hall Jr. also agrees to provide his father a decent burial upon his death. Countersigned by John Paddack, Isaac Chapman Jr., Peter Thacher as Justice of the Peace, and Jonathan Thacher as Register. The document has flattened folds, with uneven toning and foxing. A few small separations and holes at the folds. Boldly signed by all parties, with Hall Jr.'s seal to the right of his signature.

Elisha Hall Sr. (1655-1747) resided in Yarmouth, Barnstable, Massachusetts and was married to Lydia Farrand (1656-1724). The couple had eight children, with Elisha Hall Jr. being the second son. Lydia died the year this document was drawn up, which may be the reason Elisha Hall Jr. felt it necessary to provide for his father. Unfortunately, Elisha Hall Jr. (1682-1743) predeceased his father, passing away at the age of 60, while his father lived until the age of 91-92.

All items will ship with signature required, and full insurance. Most items are sent via Federal Express, with P. O. Box addresses being sent through USPS. We insure through Berkley Asset Protection with rates of $.70 per $100 of value, among the lowest insurance rates in the industry. Our shipping department cameras document every package, both outgoing and incoming, for maximum security. In addition, we compare our shipping and handling rates against those of other auction houses, to ensure that our charges are among the lowest in the trade.

Upon winning your item(s), you will receive an invoice with our in-house shipping and handling fees included. ***We will ship to the address as it appears on your invoice, unless you inform us otherwise, immediately upon your receipt of invoice***

International shipments: In order to comply with our insurance provider, all international shipments will be sent via Fed Ex and customs paperwork will show a value of $1.00. International buyers should contact our office directly with any questions regarding this policy.

Third Party Shipping Option: If a third party shipper is preferred, the buyer is responsible for contacting them directly to make shipping arrangements. For your convenience, we have provided some recommended shippers.
